These terms apply when you use philogeni.com or buy from us. Please read them. By placing an order or using this site, you agree to them.
We have written these in plain language on purpose. If anything here is unclear, email hello@philogeni.com and ask.
1. Who We Are
Philogeni Skincare Inc. is a company incorporated in British Columbia, Canada. Our products are formulated and manufactured in British Columbia.
In these terms, "we," "us" and "our" mean Philogeni Skincare Inc. "You" means the person using this site or placing an order.
2. Who Can Buy From Us
You must be at least 18 years old, or the age of majority where you live, to place an order or create an account.
We sell to customers in Canada and the United States. We do not currently ship to Quebec or to countries outside Canada and the United States. See our Shipping Policy.
3. Our Products
What they are. Philogeni products are cosmetics. They are formulated to care for, cleanse, protect and support the appearance and condition of the skin.
What they are not. They are not drugs, natural health products, or medical treatments. They are not intended to diagnose, treat, cure or prevent any disease or medical condition, and nothing on this site should be taken as medical advice. If you have a skin condition, are pregnant or breastfeeding, or are taking prescription treatments for your skin, speak with a physician, dermatologist or pharmacist before changing your routine.
Patch testing. We recommend patch testing any new product before regular use. Apply a small amount to the inner forearm and wait 24 hours. If you notice irritation, redness, stinging or any other reaction, stop using the product and let us know at hello@philogeni.com.
Results vary. Skin is individual. Age, hormonal stage, climate, existing routine, medications and genetics all affect how any product performs. We do not promise a specific outcome, and any before-and-after imagery, review or testimonial on this site reflects one person's experience rather than a typical result.
Ingredients. We publish a full ingredient list for every product. If you have a known sensitivity or allergy, please read it before ordering. It is your responsibility to check whether a product is suitable for you.
Formulation changes. We may improve or reformulate products over time. When we do, the ingredient list on the site and the packaging is updated. Always read the packaging you receive.
4. Orders and Pricing
Order acceptance. Your order is an offer to buy. We accept it when we send you a shipping confirmation. Until then we may decline or cancel an order, in full or in part, for any reasonable business reason, including stock availability, suspected fraud, or a pricing or description error. If we cancel an order you have paid for, we refund you in full.
Pricing and description errors. We try to get everything right, but errors happen. If a product is listed at an incorrect price or with an incorrect description, we are not obliged to fulfil the order at that price. We will contact you, and you can choose to proceed at the correct price or cancel for a full refund.
Availability. Product availability is not guaranteed. Some products sell out or are temporarily unavailable while a batch is in production.
Currency, taxes and duties. Prices are shown in the currency indicated at checkout. Applicable sales taxes are calculated at checkout. Orders to the United States are shipped Delivered Duty Paid, with duties and import taxes calculated and collected at checkout, so there is nothing further to pay on delivery.
Payment. Payment is processed by our payment providers. We do not store your full card details.
Promotions and discount codes. Discount codes are subject to their own terms, cannot be combined unless we say so, have no cash value, and may be withdrawn or expire. We may cancel an order where a code has been used in a way it was not intended.
5. Subscriptions
If you buy on a subscription, you are agreeing to a recurring order and a recurring charge until you cancel. You can cancel at any time with no fee. Full terms are in our Purchase Options Cancellation Policy.
6. Shipping, Returns and Our Guarantee
Delivery timelines, carriers and costs are set out in our Shipping Policy.
Our 60-Day Guarantee, our 30-day unopened return window, and how we handle damaged or incorrect items are set out in our Return and Refund Policy.
Those policies form part of these terms.
7. Your Account
If you create an account, you are responsible for keeping your login details secure and for activity that happens under your account. Tell us promptly if you think someone else has accessed it. We may suspend or close an account that is being used in breach of these terms.
8. Reviews and Anything You Post
We welcome honest reviews, including critical ones. If you submit a review, photo, comment or other content to us or through our site:

You confirm it is your own, that it is truthful, and that you have the right to share it.

You give us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce and adapt it in connection with our business, including on our site, in email and on social media, with attribution to the first name and initial you provided.

You can ask us to remove your content at any time by emailing hello@philogeni.com. We will remove it from anything we control going forward.
We may decline to publish or may remove content that is unlawful, abusive, misleading, makes medical claims about our products, infringes someone else's rights, or is not a genuine account of a real experience.
We do not offer payment, product or discounts in exchange for a positive review, and we do not remove reviews for being unfavourable.
9. Using This Site
Please do not use this site to break the law, interfere with its operation or security, scrape or harvest data, misrepresent who you are, resell our products without a wholesale agreement, or infringe anyone's rights.
We may suspend access to anyone who does.
10. Our Intellectual Property
The Philogeni name, logo, product names, formulations, packaging design, photography, written content, ingredient library and blog articles are owned by Philogeni Skincare Inc. or used under licence. You may not copy, reproduce or use them commercially without our written permission.
You are welcome to share our content on social media in the normal way, with credit.
11. Links to Other Sites
We sometimes link to other websites. We do not control them and are not responsible for their content, products or privacy practices.
12. Disclaimers and Limits on Our Liability
We provide this site as it is. We do not warrant that it will always be available, error free, or free of anything harmful.
To the fullest extent the law allows, and except as set out below, we are not liable for indirect, incidental, special or consequential losses, or for loss of profit, revenue or data, arising from your use of this site or our products. Where we are liable, our total liability is limited to the amount you paid for the order the claim relates to.
Nothing in these terms limits or excludes:

Liability for death or personal injury caused by our negligence

Liability for fraud or fraudulent misrepresentation

Your rights under the British Columbia Business Practices and Consumer Protection Act, the British Columbia Sale of Goods Act, or the consumer protection law of your own province or state

Any other liability that cannot lawfully be limited or excluded
If any part of this section is found unenforceable, the rest continues to apply.
13. Indemnity
If you breach these terms and that causes us loss, cost or a third-party claim, you agree to cover us for it, to the extent the law allows.
14. Privacy
How we handle your personal information is set out in our Privacy Notice.
15. Governing Law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. Any dispute will be dealt with by the courts of British Columbia, and you and we agree to their jurisdiction.
If you are a consumer, this does not deprive you of the protection of any mandatory consumer protection law in the place where you live, and does not prevent you from bringing a claim in your local courts where the law gives you that right.
16. Changes to These Terms
We may update these terms. The version that applies to your order is the one published when you placed it. We will post any changes here with a new date at the top, and we will tell you directly if a change is significant.
17. General
If any part of these terms is found to be unenforceable, the rest stays in force. If we do not enforce a term straight away, that does not mean we have given it up. These terms, together with the policies referred to in them, are the whole agreement between you and us about your use of this site and your orders.
